CREATOUR, LLC – TRAVELER TERMS & CONDITIONS

Thank you for choosing CreaTour, LLC ("CreaTour," "we," "us," "our"). These Traveler Terms & Conditions (the "Agreement") are a legally binding contract between you ("you," "the traveler") and CreaTour.
Please read this document carefully. By paying your deposit, you confirm your understanding and acceptance of this Agreement.
1. THE AGREEMENT & BOOKING PROCESS
(a) Your Agreement with Us: This Agreement describes our mutual responsibilities and obligations. Your payment of a deposit for a Tour signifies your acceptance of these Terms & Conditions.
(b) Deposit & Final Payment:

A non-refundable deposit of 15% of the total Tour cost per person is required to reserve your space on a Tour.

The final balance is due 90 days prior to the Tour's departure date.

If you book within 90 days of departure, full payment is due at the time of booking.

If final payment is not received by the due date, we reserve the right to cancel your reservation.
(c) Pricing & Surcharges: All prices are in U.S. dollars and are per person, based on double occupancy. Prices are subject to change without notice until your deposit is received. Once we receive your deposit, your land price is guaranteed. The only exception is for significant new government-imposed taxes or fees, in which case we may pass on these surcharges.
2. WHAT THE TOUR PRICE INCLUDES
(a) Included in the Land Price:

All accommodations as specified in the itinerary.

All ground transportation (coaches, private vehicles) during the Tour.

All meals, activities, and sightseeing as specified in the itinerary.

The services of your CreaTour Destination Coordinator and expert local guides.

All specified entrance fees and gratuities for included meals.
(b) Not Included in the Land Price (Exclusions):

International and internal airfare.

Optional travel protection/insurance (highly recommended).

Passport and visa fees.
-
Meals not specified in the itinerary ("on your own" meals).

Optional activities.
-
Gratuities for your guides and drivers.
-
Personal expenses (laundry, room service, souvenirs, etc.).
3. CANCELLATION & REFUND POLICY
Your cancellation notice must be sent to us in writing (email is acceptable). Your cancellation fee is determined by the date we receive your written notice.
(a) Cancellation by You (The Traveler):

91+ days prior to departure: Full refund of payments made, minus the non-refundable deposit.

61 to 90 days prior to departure: 50% of the total Tour price (cancellation fee).
-
60 days or less prior to departure: 100% of the total Tour price (cancellation fee / no refund).
You acknowledge that the cancellation fees above are not a penalty, but a reasonable liquidation of damages to CreaTour for the non-refundable supplier payments we make on your behalf.
(b) Cancellation by CreaTour (Low Enrollment): We reserve the right to cancel any Tour for insufficient enrollment. We will make this "go/no-go" decision no later than 60 days prior to departure. If we cancel your Tour for this reason, our sole liability shall be to provide you with a full refund of all monies paid to us. We are not responsible for any other costs you may have incurred (e.g., non-refundable airline tickets).
(c) Cancellation by CreaTour (Force Majeure): CreaTour shall not be liable for any failure to perform, or delay, due to a Force Majeure Event. A "Force Majeure Event" includes acts of God, war, terrorism, pandemic, government prohibitions, natural disasters, or any other event beyond our reasonable control.
If we must cancel a Tour due to a Force Majeure Event, our sole obligation is to provide a refund of recoverable funds only, less a non-refundable administrative fee of 15% of the total Tour cost per person. You acknowledge that unrecoverable funds include payments made to suppliers that do not refund us, as well as the value of the work and services we have already performed.
This is why we insist you purchase comprehensive "Cancel for Any Reason" travel protection.
(d) Itinerary Modifications: We will make every effort to operate the Tour as advertised. However, we reserve the right to make reasonable modifications to the itinerary (e.g., substitute a hotel, alter the sequence of a day's events) as deemed necessary for the safety, comfort, or operational success of the Tour.
(e) Credit Card Chargebacks: You represent and warrant that you will not dispute or initiate a chargeback for any payment made to us if we have abided by the cancellation terms of this Agreement. In the event you initiate a chargeback in violation of this Agreement, you agree to reimburse CreaTour for the full amount of the chargeback plus any dispute fees and legal costs incurred.
4. YOUR RESPONSIBILITIES (THE TRAVELER)
(a) Passports & Visas: You are solely responsible for obtaining and maintaining a valid passport (with at least six months of validity beyond the Tour's end date) and any necessary visas.
(b) Health & Fitness: Our "slow travel" philosophy emphasizes immersive experiences and comfortable pacing, but it is not passive. To fully participate, you warrant that you are in good general health and can comfortably manage a moderate level of activity. Our Tours may require:

Walking for up to 2-3 miles, spread throughout the day, often on uneven terrain (e.g., cobblestones, ancient sites).

The ability to climb stairs without assistance and stand for extended periods (e.g., in museums).
You must notify us in writing at the time of booking of any physical conditions, limitations, or mobility needs. We will consult with you to determine if reasonable accommodations are possible.
Our primary commitment is to the safety and enjoyment of the entire group. If we determine, in good faith, that a traveler's condition cannot be reasonably accommodated, or may impede the safe operation of the Tour or the enjoyment of other travelers, we reserve the right to decline the reservation.
Accessibility Warning: You acknowledge that international destinations may not adhere to U.S. ADA (Americans with Disabilities Act) standards. Many sites are not wheelchair accessible. If you require mobility assistance (e.g., a wheelchair, walker, or help climbing stairs), you must travel with a companion capable of providing such assistance. CreaTour staff cannot provide personal mobility assistance.
(c) Conduct: You are responsible for respecting the laws and customs of the destination and the guidance of our staff. We reserve the right to remove any traveler from the Tour whose conduct is disruptive or endangers themselves, other travelers, or our staff. In such a case, you will be responsible for all costs of your removal and will receive no refund.
(d) Baggage: CreaTour assumes no liability for lost, stolen, or damaged baggage. Your baggage is your sole responsibility.
5. LIABILITY, RISK & TRAVEL PROTECTION
(a) Assumption of Risk: You acknowledge that travel involves inherent risks, including illness, injury, and loss of property. By booking, you voluntarily assume all such risks associated with your participation.
(b) Limitation of Liability (Third-Party Suppliers): CreaTour acts as an intermediary for independent third-party suppliers, such as Destination Management Companies (DMCs), hotels, airlines, and transport providers. We have vetted these suppliers for quality but we do not own, operate, or control them.
CreaTour shall not be liable for any injury, loss, damage, death, or expense to person or property caused by the willful or negligent act or omission of any such independent supplier, or by any other cause beyond our direct control.
(c) Travel Protection (Insurance): We consider comprehensive travel protection to be an essential part of your booking. We strongly urge you to purchase a plan that covers, at a minimum:

u from our 100% non-refundable cancellation policy (Section 3a) and a Force Majeure event (Section 3c). We recommend a "Cancel for Any Reason" (CFAR) policy.

Emergency Medical Coverage: Note that your domestic health plan (e.g., Medicare) may provide no coverage outside the U.S.

Emergency Medical Evacuation, Baggage Loss/Delay, and Travel Delay.
Your decision not to purchase travel protection is at your own risk.
6. PRIVACY, DATA CONSENT & MEDIA RELEASE
(a) Data & Privacy Consent (Required for Booking): To operate your Tour, we must collect Personal Data (e.g., name, passport details) and Sensitive Data (e.g., dietary needs, medical conditions). By booking, you explicitly consent to the following:

We will collect and use this data to make your reservations.

We must share this data with our suppliers (e.g., DMCs, hotels, airlines) to fulfill their services.

This includes the international transfer of your data to the destination country, which may have different data protection laws than the U.S. Our full Privacy Policy, which governs our data practices, is available on our website and is incorporated by reference into this Agreement.
(b) Photographic Release: We reserve the right to take photographs and videos during the Tour. By booking, you grant us a non-exclusive, worldwide, royalty-free license to use your likeness in our promotional and marketing materials. If you do not wish to be included, you must notify us in writing before the Tour departure.
7. GOVERNING LAW & DISPUTE RESOLUTION
(a) Governing Law: This Agreement shall be governed by the laws of the State of Massachusetts, USA.
(b) Mandatory Binding Arbitration: Any dispute arising from this Agreement or your Tour shall be resolved exclusively through binding arbitration in Middlesex County, Massachusetts in accordance with the rules of the American Arbitration Association.
By agreeing to these terms, you are waiving your right to a jury trial or to participate in a class-action lawsuit.
8. FINAL AGREEMENT
This Agreement (along with our Privacy Policy and your Tour Itinerary) constitutes the entire agreement between you and CreaTour. No modification shall be valid unless in writing and signed by both parties.
